Listing.Press is a United States-based independent public information, aggregation, and local information platform.

Listing.Press respects the intellectual property rights of publishers, photographers, creators, businesses, organizations, users, and other rights holders.

This Copyright & DMCA Policy explains our general approach to copyrighted material, source attribution, copyright complaints, takedown requests, counter-notifications, and matters arising under the United States Digital Millennium Copyright Act (“DMCA”).

This Policy should be read together with our Terms of Use, Sources & Attribution Policy, and Corrections Policy.

1. Respect for Copyright

Listing.Press respects copyright and other intellectual property rights.

Third-party material appearing on or referenced by Listing.Press may be protected by copyright or other legal rights.

Unless explicitly stated otherwise, Listing.Press does not claim ownership of third-party:

  • Research

  • Trademarks
  • Publications
  • Other copyrighted works

Copyright remains with the applicable rights holder unless ownership or licensing terms provide otherwise.

2. Aggregation and Source-Based Publishing

Listing.Press may identify, organize, summarize, categorize, reference, or link to publicly accessible information from third-party sources.

The presence of information on Listing.Press does not mean that Listing.Press claims ownership of the underlying third-party reporting or creative work.

Our aggregation activities may include:

  • Summarizing factual information
  • Geographically organizing information
  • Categorizing information by subject
  • Linking to original sources
  • Cross-referencing multiple sources
  • Creating timelines
  • Providing public-interest context
  • Identifying relevant jurisdictions

Listing.Press generally seeks to avoid unnecessarily reproducing substantial portions of third-party publications where summarization, attribution, or linking can communicate the relevant information.

3. Attribution Is Not a Copyright License

Listing.Press aims to provide appropriate attribution where third-party information or material is used.

Providing attribution or a source credit does not itself create permission to reproduce copyrighted material.

Copyright questions are therefore evaluated separately from questions of attribution.

A request to correct attribution may be handled differently from a request alleging copyright infringement.

4. Facts and Copyrighted Expression

Listing.Press may report, organize, summarize, or discuss factual information obtained from publicly accessible sources.

Copyright protection and the legal status of particular material depend on applicable law and the circumstances of the specific work.

Listing.Press does not assume that all publicly accessible material is free of copyright protection merely because it can be viewed online.

5. Photographs, Images and Visual Media

Photographs, illustrations, videos, graphics, maps, and other visual materials may be protected by copyright even when they are publicly accessible online.

Listing.Press may use visual material where there is an appropriate legal basis, which may include:

  • Permission from the rights holder
  • A valid license
  • Material supplied for publication by an authorized party
  • Public-domain status
  • Another legally applicable authorization or exception

Source attribution alone should not be interpreted as a representation that copyrighted visual material has entered the public domain.

6. User and Community Submissions

Listing.Press may allow members of the public, businesses, organizations, or other users to submit photographs, text, listings, reports, notices, documents, graphics, or other content.

A person submitting material represents that they have the rights or lawful authority reasonably necessary to provide that material for the intended use.

Users should not submit copyrighted material belonging to another person or organization unless they have appropriate permission or another lawful basis to do so.

7. Copyright Complaints

If you believe that copyrighted material has been used on Listing.Press without authorization in a manner that infringes your rights, you may submit a copyright complaint.

Please provide enough information for Listing.Press to identify and evaluate the material concerned.

8. DMCA Notice-and-Takedown Procedure

Listing.Press intends to respond appropriately to sufficiently supported notifications of claimed copyright infringement under applicable United States law, including the Digital Millennium Copyright Act.

If you are a copyright owner or an agent authorized to act on behalf of a copyright owner and believe that material available through Listing.Press infringes an exclusive copyright right, you may submit a written notification.

9. Information Required in a DMCA Notification

To be effective under 17 U.S.C. § 512(c)(3), a notification of claimed infringement should substantially include:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, where multiple copyrighted works on Listing.Press are covered by a single notification, a representative list of those works.
  3. Identification of the material claimed to be infringing or to be the subject of infringing activity and information reasonably sufficient to allow Listing.Press to locate the material.
  4. Information reasonably sufficient to allow Listing.Press to contact the complaining party, such as an address, telephone number, and email address.
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right allegedly infringed.

10. Identifying the Material

Copyright complaints should identify the material with enough specificity for us to locate it.

Where possible, please include:

  • The exact Listing.Press URL
  • The title of the relevant page or publication
  • A description of the copyrighted work
  • The location of the allegedly infringing material on the page
  • A link to or other evidence identifying the original copyrighted work
  • The name of the rights holder

A general request such as “remove all my content” without sufficient identification may not provide enough information to evaluate or locate the material.

Where Listing.Press has registered a designated DMCA agent with the United States Copyright Office, the currently published designated-agent information should be used for formal DMCA notices.

12. Review of Copyright Complaints

Upon receiving a copyright complaint, Listing.Press may evaluate:

  • Whether the complaint contains sufficient information
  • Whether the complaining party appears authorized to act for the rights holder
  • The material identified in the complaint
  • The source and circumstances of the material
  • Relevant licensing information
  • Relevant permissions
  • Whether additional information is reasonably necessary
  • Applicable United States copyright law

Listing.Press may request clarification or additional information when a complaint is incomplete.

13. Removal or Disabling Access

Where appropriate after receiving a valid or sufficiently supported copyright notification, Listing.Press may act expeditiously to remove or disable access to the material concerned.

Depending on the circumstances, Listing.Press may:

  • Remove an image
  • Remove a document
  • Remove or modify text
  • Disable access to specific material
  • Remove an entire publication
  • Replace material with properly licensed material
  • Correct source attribution
  • Temporarily restrict material while reviewing a complaint

Removal or restriction of material does not itself constitute an admission that infringement occurred.

14. Notice to the Content Provider

Where required by applicable law and where relevant user information is available, Listing.Press may notify the person responsible for material removed or disabled following a DMCA notification.

That person may have the right to submit a counter-notification where they believe the material was removed because of mistake or misidentification.

15. DMCA Counter-Notification

If material you provided has been removed or disabled as a result of a DMCA notification and you believe the removal resulted from mistake or misidentification, you may submit a counter-notification where permitted by applicable law.

A counter-notification under 17 U.S.C. § 512(g) should substantially include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or to which access was disabled and the location where the material appeared before removal or disabling.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement consenting to the jurisdiction of the appropriate United States Federal District Court as required by 17 U.S.C. § 512(g), including the applicable provision for persons whose addresses are outside the United States.
  6. A statement that you will accept service of process from the person who submitted the original infringement notification or that person’s agent.

16. Counter-Notice Processing

When Listing.Press receives a valid counter-notification, it may provide a copy to the party who submitted the original copyright notification as required or permitted by applicable law.

Under the DMCA process, qualifying material may generally be restored not less than ten and not more than fourteen business days after receipt of a compliant counter-notification unless the original complaining party informs the service provider that it has filed an appropriate court action seeking to restrain the alleged infringement.

Listing.Press will handle counter-notifications according to applicable United States law and the circumstances of the particular request.

17. Misrepresentations in DMCA Notices

DMCA notifications and counter-notifications are legal communications.

Persons submitting them should ensure that the statements they make are accurate and made in good faith.

Knowingly making material misrepresentations regarding alleged infringement or wrongful removal may result in legal consequences under applicable United States law.

18. Fair Use and Other Limitations

United States copyright law recognizes limitations and exceptions that may apply in certain circumstances, including fair use under 17 U.S.C. § 107.

Whether a particular use qualifies as fair use or another exception depends on the specific facts and applicable law.

Listing.Press does not represent that attribution alone establishes fair use, nor does the presence of a copyright complaint automatically establish that the challenged use constitutes infringement.

Copyright disputes may involve legal questions that ultimately can only be conclusively resolved by agreement between the parties or by a court with appropriate jurisdiction.

19. Public Domain and Government Materials

Some materials may be in the public domain or otherwise subject to different copyright rules.

The copyright status of government-created materials may depend on the issuing government, jurisdiction, authorship, and circumstances of creation.

Listing.Press does not assume that every document hosted on a government website is necessarily free of third-party copyright interests.

20. Licensed Material

Listing.Press may use material made available under a license.

Applicable license conditions may require:

  • Attribution
  • Identification of the creator
  • A link to the license
  • Identification of modifications
  • Restrictions on commercial use
  • Other conditions

Listing.Press may modify or remove material if it determines that relevant license requirements are not being satisfied.

21. Source Links

Listing.Press frequently links to third-party websites to allow readers to access original sources.

Linking to an external publication does not transfer ownership of that publication to Listing.Press.

Listing.Press does not control whether an external rights holder later changes, moves, restricts, licenses, or removes material.

22. Automated and AI-Assisted Systems

Listing.Press may use automated systems or artificial intelligence tools to assist with source discovery, categorization, summarization, deduplication, formatting, translation, or publishing workflows.

Automated processing does not create ownership rights in third-party copyrighted works.

Listing.Press may correct, restrict, or remove material where automated processing has resulted in inappropriate reproduction, attribution, or presentation of copyrighted material.

23. Repeat Infringer Policy

Where applicable to the features and users of the Service, Listing.Press maintains a policy of restricting or terminating access, accounts, submission privileges, or other participation privileges of users who repeatedly infringe copyrights in appropriate circumstances.

Measures may include:

  • Rejecting future submissions
  • Removing previously submitted material
  • Restricting community-submission privileges
  • Suspending an account where accounts are provided
  • Terminating an account in appropriate circumstances
  • Blocking abusive submission activity

Listing.Press may consider the circumstances and reliability of copyright complaints when applying this policy.

24. Standard Technical Measures

Where Section 512 of the DMCA applies, Listing.Press intends not to interfere with qualifying standard technical measures used by copyright owners to identify or protect copyrighted works, as provided by applicable United States law.

25. Copyright Complaints Versus Corrections

A copyright complaint is different from a factual correction request.

If information is factually incorrect but does not involve copyright infringement, please use the procedures described in our Corrections Policy.

If the issue concerns incorrect source attribution, please review our Sources & Attribution Policy.

26. Copyright Complaints Versus Privacy Requests

A request to remove material because of privacy concerns is not necessarily a copyright claim.

Privacy-related requests should be submitted through our Legal Contact page and may be evaluated under our Privacy Policy and applicable law.

27. Trademark Matters

The DMCA primarily concerns copyright and should not generally be used as a substitute for trademark complaints.

Trademark owners who believe material on Listing.Press unlawfully infringes or misuses their rights may contact us through our Legal Contact page and provide sufficient information to identify the issue.

28. Fraudulent or Abusive Complaints

Listing.Press reserves the right to take reasonable measures against fraudulent, abusive, repetitive, or bad-faith copyright complaints.

Submitting a complaint does not automatically guarantee removal.

Listing.Press may decline to act on requests that:

  • Do not identify copyrighted material
  • Do not identify the material complained of
  • Appear unrelated to copyright
  • Contain materially inconsistent information
  • Cannot reasonably be authenticated
  • Are otherwise legally insufficient

This does not limit our obligation to respond appropriately to legally valid notifications.

29. No Admission of Liability

Removal, restriction, modification, replacement, or restoration of material in response to a copyright complaint does not by itself constitute an admission of:

  • Copyright infringement
  • Wrongdoing
  • Negligence
  • Ownership
  • Liability

Listing.Press may take precautionary action while a dispute is being evaluated.

30. Designated DMCA Agent

United States law provides a process through which eligible online service providers may designate an agent to receive notifications of claimed copyright infringement.

Where Listing.Press relies on the applicable protections of 17 U.S.C. § 512 and maintains a designated agent, the designated agent information will be made publicly accessible as required by applicable law.

The United States Copyright Office maintains a public directory of registered DMCA designated agents.

Formal notices should use the designated-agent information published by Listing.Press and/or the current information contained in the U.S. Copyright Office directory where applicable.

31. United States Law

Listing.Press is a United States-based service.

This Copyright & DMCA Policy is intended to operate within the framework of applicable United States copyright law, including:

  • Title 17 of the United States Code
  • The Digital Millennium Copyright Act
  • 17 U.S.C. § 512
  • Other applicable federal copyright provisions

Nothing in this Policy is intended to expand or restrict rights provided by applicable law.

32. International Copyright Claims

Listing.Press may be accessible outside the United States.

Rights holders outside the United States may also submit copyright concerns.

Because copyright laws vary by jurisdiction, Listing.Press may evaluate international complaints according to applicable law, the location and nature of the Service, the material concerned, and other relevant circumstances.

33. Preservation of Records

Listing.Press may retain records relating to copyright complaints, notices, counter-notifications, removal decisions, correspondence, and repeat-infringer determinations where reasonably necessary for:

  • Legal compliance
  • Dispute resolution
  • Platform security
  • Recordkeeping
  • Enforcement of this Policy

Such information will be handled in accordance with our Privacy Policy and applicable law.

34. Changes to This Policy

Listing.Press may update this Copyright & DMCA Policy to reflect:

  • Changes to the Service
  • Changes in United States copyright law
  • Changes to our community submission systems
  • Changes to our designated-agent information
  • Changes to our copyright handling procedures
